1. Acceptance of Terms

By installing and using Amazon Associates Dashboard Pro ("the Extension"), you agree to be bound by these Terms of Service. If you don't agree to these terms, please don't use the Extension.

These terms apply to both the FREE version and the PRO version of the Extension.

2. Description of Service

Amazon Associates Dashboard Pro is a browser extension that provides:

FREE Version:

• ✅ Sales dashboard for yesterday, this week, and this month
• ✅ Automatic data updates
• ✅ Local data caching
• ✅ 100% privacy-focused architecture

PRO Version (Paid Subscription):

• ✅ All FREE features
• ✅ Real-time sales data for TODAY
• ✅ Instant browser notifications for new sales
• ✅ Updates every 5 minutes
• ✅ Pinned tab mode for efficiency
• ✅ Priority support
• ✅ Early access to new country support

3. User Responsibilities

By using the Extension, you agree to:

• ✅ Have a valid Amazon Associates account in good standing
• ✅ Comply with Amazon Associates Operating Agreement and all applicable Amazon policies
• ✅ Use the Extension only for monitoring your own Amazon Associates account
• ✅ Not attempt to reverse engineer, decompile, or modify the Extension
• ✅ Not use the Extension in any way that violates applicable laws or regulations
• ✅ Not share your PRO license key with others
• ✅ Not abuse the Extension to make excessive requests to Amazon's servers

4. Amazon Associates Compliance

You acknowledge that:

• You are solely responsible for compliance with Amazon Associates Operating Agreement
• The Extension accesses Amazon's services using your existing authentication
• We are not responsible if Amazon changes their API or policies
• Amazon may terminate or suspend your Associates account for any reason
• Use of this Extension is at your own risk regarding Amazon's policies

5. PRO Subscription Terms

5.1 Pricing

• Monthly: R$ 9,90/month (or equivalent in your currency)
• Annual: R$ 104,90/year (16% savings vs monthly)

Prices are subject to change with 30 days notice to existing subscribers.

5.2 Payment

• Payments are processed securely through Stripe
• Subscriptions auto-renew unless cancelled
• You will receive a license key via email after payment
• License keys are for personal use only - one key per subscriber

5.3 Cancellation & Refunds

• ✅ You can cancel your subscription at any time
• ✅ Cancellation takes effect at the end of your current billing period
• ✅ No refunds for partial months/years already paid
• ✅ To cancel, contact us via WhatsApp or manage through Stripe portal
• ✅ After cancellation, your license will continue working until period end

5.4 Free Trial / Promotional Offers

Promotional discounts (e.g., EARLYBIRD50) apply only to the first payment. Subsequent renewals are at regular price unless otherwise stated.

6. License Grant

Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Install and use the FREE version of the Extension
• Install and use the PRO version if you have an active paid subscription

This license does NOT allow you to:

• ❌ Resell, redistribute, or sublicense the Extension
• ❌ Use the Extension for commercial purposes beyond your own affiliate marketing
• ❌ Modify, reverse engineer, or create derivative works
• ❌ Share your PRO license key with others

7. Intellectual Property

The Extension, including all code, design, graphics, and documentation, is owned by AgileHero and protected by copyright and other intellectual property laws. "Amazon" and "Amazon Associates" are trademarks of Amazon.com, Inc. We are not affiliated with Amazon.

8. Privacy & Data

Our approach to privacy is simple: we don't collect any data. Please review our Privacy Policy for complete details on how the Extension works and what (minimal) data is stored locally in your browser.

9. Service Availability

We strive to provide reliable service, but:

• The Extension may experience downtime or interruptions
• Amazon may change their API, breaking functionality temporarily
• We may need to perform maintenance or updates
• Features may be added, modified, or removed

We do not guarantee 100% uptime or uninterrupted service.

10. Updates & Changes

We may update the Extension at any time to:

• Fix bugs or security issues
• Add new features
• Improve performance
• Maintain compatibility with Amazon's changes
• Comply with browser or platform requirements

Updates may be automatic through the Chrome Web Store. Major changes will be announced in update notes.

11. Disclaimer of Warranties

We explicitly disclaim all warranties, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, completeness, or reliability of data
• Warranties of uninterrupted or error-free service
• Warranties regarding compatibility with Amazon's systems

You acknowledge that:

• Sales data displayed may not be 100% accurate or real-time
• The Extension relies on Amazon's API and cookies, which may change
• Notifications may be delayed or missed
• We cannot guarantee Amazon will not block or restrict the Extension

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGILEHERO SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Suspension or termination of your Amazon Associates account
• Inaccurate sales data or missed notifications
• Service interruptions or Extension failures

Our total liability for any claims related to the Extension shall not exceed the amount you paid for the PRO subscription in the 12 months prior to the claim (or R$ 50 for FREE users).

13. Indemnification

You agree to indemnify and hold harmless AgileHero, its developers, and affiliates from any claims, damages, or expenses arising from:

• Your use or misuse of the Extension
• Your violation of these Terms or any applicable laws
• Your violation of Amazon's terms or policies
• Your Amazon Associates account activities

14. Termination

14.1 Termination by You

• Uninstall the Extension at any time
• Cancel PRO subscription at any time
• Contact us to request account deletion (though we don't store accounts)

14.2 Termination by Us

We may suspend or terminate your access to PRO features if:

• You violate these Terms
• Your payment fails or is disputed
• You abuse the Extension or our support
• Required by law or Amazon's policies

14.3 Effect of Termination

• FREE version continues to work (it's client-side only)
• PRO features immediately stop working upon license revocation
• No refunds for early termination (except at our discretion)

15. Geographic Restrictions

Currently supported regions:

• ✅ Brazil (associados.amazon.com.br)

Planned future support:

• 🔜 United States, United Kingdom, Germany, France, Italy, Spain, Canada, Mexico, Japan, Australia

The Extension may not function properly in unsupported regions.

16. Third-Party Services

Stripe (Payment Processor)

PRO subscriptions are processed through Stripe. By subscribing, you agree to Stripe's Terms of Service and Privacy Policy.

Amazon Associates

The Extension integrates with Amazon Associates. You must comply with Amazon's Operating Agreement and Terms of Service.

17. Changes to Terms

We may update these Terms from time to time. Changes will be effective upon posting with an updated "Last Updated" date. Material changes will be announced through:

• Extension update notes
• Email to PRO subscribers (if we collect emails in future)
• Notice on our website

Continued use after changes constitutes acceptance of new terms.

18. Governing Law & Disputes

18.1 Governing Law

These Terms are governed by the laws of Brazil, specifically the state of São Paulo, without regard to conflict of law principles.

18.2 Dispute Resolution

Before filing any legal action, you agree to:

1. Contact us via WhatsApp or email to attempt informal resolution
2. Provide 30 days for us to address your concern

18.3 Arbitration (for claims over R$ 1,000)

If informal resolution fails, disputes shall be resolved through binding arbitration in São Paulo, Brazil, rather than in court, except for:

• Small claims court actions (under R$ 1,000)
• Intellectual property disputes
• Injunctive relief

19. Miscellaneous

19.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AgileHero regarding the Extension.

19.2 Severability

If any provision is found unenforceable, the remaining provisions continue in full effect.

19.3 No Waiver

Our failure to enforce any right or provision doesn't constitute a waiver of that right.

19.4 Assignment

You may not transfer or assign your rights under these Terms. We may assign our rights to any affiliate or successor.

19.5 Force Majeure

We're not liable for delays or failures due to circumstances beyond our reasonable control (e.g., Amazon API changes, natural disasters, pandemics).
